Prepared to meet Irish/EU legal and GDPR standards for a service-based HVAC business

0) Plain‑English summary

  • Service = routine maintenance when the system is running. Repair/Diagnostics Call‑Out applies if the unit is not operating on arrival.
  • Transparent pricing and no extra work without your approval.
  • 30‑day workmanship recall on our work and manufacturer warranty on parts.
  • You provide safe, unobstructed access and utilities.
  • 48‑hour free cancellation/reschedule, €50 late‑change fee if shorter notice.
  • Some items are excluded unless quoted separately.

1) Introduction

These Terms govern the provision of services by Wise Heat HVAC Solutions Ltd, trading as WiseHeat.ie, to any customer (“you”). By booking or using our services you accept these Terms.


2) Scope of Services

We provide:

  • Heat pump servicing, maintenance, and troubleshooting
  • Air conditioning servicing & maintenance
  • F‑Gas leak detection, repairs, and compliance services
  • Thermal imaging inspections (domestic & light commercial)
  • Preventative Maintenance Contracts (PPMs)

We reserve the right to update services at any time and follow manufacturer/OEM guidance where practical.


3) Service vs Repair

Service: System operating on arrival. We perform our published 50‑point checklist (Annex A) and issue a PDF report.
Repair/Diagnostics: System not operating, faults/alarms present, or fault‑finding needed. Diagnostics call‑out covers first hour; extra labour/parts only with your approval.


4) Bookings, Availability & Hours

Book via website, phone, or email. We confirm appointment by SMS/email.
Standard hours: Mon–Fri 08:00–16:30 (excluding bank holidays). Out‑of‑hours visits by prior agreement with surcharge.


5) Client Responsibilities

  • Provide safe, unobstructed access to indoor/outdoor units and utilities.
  • Ensure adult presence and keep pets/children away from work area.
  • Disclose all known faults, prior work, restrictions.
  • Where subcontractors (e.g. electricians, builders) are required and you contract directly with them, WiseHeat.ie has no liability for their work or charges. This ensures Revenue RCT does not apply to our engagement.
  • Unsafe or inaccessible sites may be aborted and charged as a call‑out.

6) Pricing & Authorisation

  • Standard service: €250 incl. VAT (within 30km Carlow).
  • Diagnostics call‑out: €200 incl. VAT covers first hour.
  • Labour thereafter: €50 per additional half‑hour.
  • Travel fees: pre‑agreed for >30km radius.
  • Parts/consumables: extra, supplied/installed only with approval.

No extra work proceeds without your consent (SMS/email accepted). Prices include VAT at current rates.


7) Payment Terms

Residential: pay on/before service day.
Commercial: 7‑day terms unless otherwise agreed.
Late payments may incur statutory interest (8% above ECB base) & admin charges.


8) Parts & Materials

OEM or quality aftermarket parts used. Lead times depend on suppliers; we are not liable for delays. Removed parts become our property unless requested before leaving site.


9) Cancellations & Rescheduling

Free up to 48h before. Inside 48h, no‑show or no‑access: €50 late‑change fee (may be waived at our discretion). If we reschedule, we offer earliest available alternative.


10) Cooling‑Off Rights

Consumers booking remotely have 14‑day right to cancel unless you request an earlier start. If fully performed within 14 days, the right to cancel ends. Business bookings not covered.


11) Warranty & Recall

  • Workmanship recall: 30 days – we return free if issue arises directly from our work. New/unrelated faults are charged at normal rates.
  • Parts: manufacturer warranty (usually 12 months). Misuse, water quality issues, freezing, power issues, or third‑party interference excluded.

12) Water Quality & Limescale

We may test pH/TDS/hardness and log in report. Corrective works (inhibitor, flush, softener) quoted separately. Failures from untreated water outside spec excluded from warranty.


13) Exclusions

Unless quoted separately, excluded items include:

  • Buried/fabric‑embedded pipework
  • Electrical works beyond isolator/consumer unit
  • Decorative panels/casings with cosmetic risk
  • De‑sludging/descaling/chemical flushes
  • Installer design errors or undersizing
  • Damage by vermin, floods, storms, power/water supply failures
  • Control rewiring/re‑zoning projects
  • General plumbing unrelated to heat pump
  • Networking/router issues for smart controls
  • Building fabric repairs (plaster/paint/carpentry)

14) No‑Fault‑Found & Training

If issue is user settings or external controls, today’s visit is charged as diagnostics. We provide brief handover to avoid repeat call‑outs.


15) Maintenance Contracts

PPM agreements set out inclusions, exclusions, response targets, and fees. We may suspend/terminate for unsafe access, repeated no‑shows, or non‑payment with written notice.


16) Privacy & Data Protection

We comply with GDPR. See our Privacy Policy and Cookie Policy at WiseHeat.ie for details of data we collect, how we use it, and your rights. We issue PDF service reports and may anonymise technical data for quality improvement.


17) Liability

Our total liability is limited to the value of the services provided, except where law prevents limitation (death/injury caused by negligence or fraud). No liability for indirect losses or business interruption. You indemnify us for losses from breach of these terms or unsafe access.


18) Force Majeure

We are not liable for delays outside our reasonable control (weather, strikes, supplier failures, utility outages).


19) Governing Law

These terms are governed by Irish law. Disputes are subject to the non‑exclusive jurisdiction of the Irish courts.


Annex A – 50‑Point Service Checklist

(As per published WiseHeat.ie checklist: system info, visual inspection, electrical checks, water circuit, refrigerant observations, heat transfer, DHW, cleaning, optimisation, reporting.)


Annex B – Notice of Hazard

Categories 1–3 (non‑conformity, at‑risk, unsafe) as defined in our field procedures.


Annex C – OEM/Brand Servicing

We follow OEM guidance for Daikin, Mitsubishi, Panasonic, Grant, Viessmann, NIBE, Hitachi, etc. Extra tasks/parts outside standard service quoted separately.
